"Because the government is unlikely to succeed on the merits of its appeal of the injunction, we deny the motion for stay," the Fifth Circuit ruled.

Texas Attorney General Ken Paxton, who is leading our States' fight for the rule of law, hailed the decision as "a victory for those committed to preserving the rule of law in America."

Absurdly, a dissenting judge claimed the dispute was "all politics" and the courts should stay out of Obama's decree-making!

"These allegations are deeply troubling because, if true, they suggest that DHS was aware for months or years that Mr. Covarrubias-Padilla posed a public safety threat to the children he was monitoring, yet took no action to revoke his DACA authorization," Grassley wrote in a letter to Homeland Security Secretary Jeh Johnson.

"Of note, news sources have reported that the Santa Clara Sheriff's Office initiated Mr. Covarrubias-Padilla's arrest after the Department of Homeland Security (DHS) contacted them with concerns about Mr. Covarrubias-Padilla's involvement in child exploitation and child pornography. These reports raise significant questions concerning the coordination of ICE and USCIS, in regards to DACA recipients," Grassley wrote.

As Grassley pointed out in his letter, this case follows on the heels of another of a KNOWN GANG MEMBER who received DACA amnesty only to go on and murder four!

According to a RAPIDLY OUTDATED Immigration and Customs Enforcement report, 12,509 illegal aliens under age 18 have been apprehended crossing our border since October. The Washington Examiner's Paul Bedard notes that this is the "second biggest surge in history after last year's"…

It is NO SURPRISE as a mere one in six – 1 in 6 – are RETURNED to their country of origin while the remaining five are "booked in" and LET GO in the U.S., presumably "eligible" for some aspect of Obama's Executive Amnesty. According to the documents, they are coming at an average pace of 2,000 a month since October.

"And this is supposed to be the slow time of year," said expert Jessica M. Vaughan, director of policy studies at the Center for Immigration Studies. "Cities and towns that have already received large numbers of unaccompanied illegal alien minors should brace themselves to repeat the process again in the coming months," she added.

Vaughan predicts this year's total UAC – unaccompanied alien children – arrival will be 42,000, roughly 14,000 less than last year's RECORD Obama-instigated surge.

That's not counting the ones NEVER CAUGHT. America is being systematically invaded and overrun…
